This Workshop Will Cover:
This presentation will focus on legal and ethical considerations for health care decision making for vulnerable adults, including adults with cognitive impairments. Participants will learn about the currently available alternatives to guardianship, such as advance health care directives, advance directives for mental health treatment, and surrogate decision making; when guardianship of the person, guardianship of the property, power of attorney, or other alternatives, are appropriate.
We will also discuss the ethical and legal framework for a possible new legislative proposal for supported decision-making that allows a person to retain their decision-making authority without appointing a substitute decision-maker. How? “People use trusted friends, family members, and professionals to help them understand the situations and choices they face, so they may make their own decisions – it is a means for increasing self-determination by encouraging and empowering people to make their own decisions about their lives to the maximum extent possible.” National Resource Center on Supported Decision-Making.
